CONTRACT

The buyer agrees to purchase a puppy call name                         

out of (dam)                                        and (sire)                               for the total amount of $                       (not including shipping).

Buyer agrees to read this contract carefully, print out this form, sign it, and send it back to  the seller, with their deposit of $300 made out to Angel Spencer.  The seller will sign the contract and give a copy back to the buyer for their records. The seller agrees to furnish the buyer with the necessary health information, including all shots and worming records.  The IOEBA registration application papers will be signed and executed at the time of sale.  You will receive temporary puppy papers.  The buyer understands that this puppy will be eligible for permanent registration. 

This puppy is sold:

(   ) WITH BREEDING RIGHTS

• Females will not be breed prior to 18 months of age or 3rd heat cycle, and males will not be used for breeding until 1 year of age.
• Breeding rights are nontransferable. If said dog is sold, spay/ neuter is required!
• Failure to comply will result in seller, buyer returning puppy/dog to seller with no refund, and buyer will pay for all costs incurred in seller getting puppy back (small claims court, transportation, ect.) Buyer understands this and agrees to give said dog back to seller with no refund if buyer does not get puppy/dog spayed/neutered before selling.

• If sold without breeding rights, puppy must be spayed/ neutered by 9 months of age. When proof of spayed/neutered (copy of vet statement indentifying dog) is provided to seller, the seller will supply registration papers at that time. Failure to comply, will result in seller not supplying registration papers, buyer returning puppy to seller with no refund, and buyer will pay for all costs incurred in seller getting puppy back (small claims court, transportation, ect.) Buyer understands this and agrees to give puppy back to seller with no refund if buyer does not get puppy spayed/neutered by 9 months of age.

DEPOSITS / PAYMENTS / SHIPPING:

Deposits are NON REFUNDABLE. In the case of premature death, prior to delivery of the puppy to you, or If the sex of your choice is unavailable you can transfer those monies to a future litter of your choice. IF YOU CHANGE YOUR MIND OR CANNOT PAY FOR YOUR PUPPY, YOU FORFEIT YOUR DEPOSIT.  The remainder of the payment must be paid in full prior to the puppy being shipped, or at time of pick up by you in cash only.  Pups are chosen in the order the deposits are received.  Seller ALWAYS has first choice in all litters.  Deposits are to be made in US Postal Money Orders, Cashiers Check, or Cash (in person only).  Once Spencerman Bullies has received your deposit the puppy will be marked and considered sold.  Puppy will be placed on hold for 4 days while we wait for your deposit to arrive.  If deposit is not received in that time frame, the puppy will be placed back up for sale.  We will offer payment plans to approved buyers (please ask for details). Spencerman Bullies will take care of all shipping arrangements for the buyer at buyer's cost.  Shipping for puppy twenty pounds and under at this time is between $300 and $375.  This is an all inclusive shipping cost and it includes your crate (which you keep), vet check and actual shipping costs. Any pup not picked up or shipped after the 10th week of age will have additional boarding fees of $25 per week, unless prior arrangements have been made in writing with Spencerman Bullies.  The buyer will also be responsible for additional vaccinations, dewormings, and any necessary vet care while the pup is still in our care.

YOUR SPENCERMAN BULLIES PUPPY IS GUARANTEED AS FOLLOWS:

1.      To be in good physical condition at the time of delivery to the buyer.  The buyer agrees to have the puppy examined by a LICENSED VETERINARIAN within Two Weeks for a complete physical examination.  If the vet finds the puppy to have a serious physical condition other than a bacterial infection, such as coccidia, or giardia, which is easily treated, the seller will replace the puppy with another puppy of comparable quality, when available either from the same litter or a future litter, AFTER, the first puppy has been returned.

2.      To be free of any genetic/hereditary defects that cause death or serious impairment of vital functions of the said puppy until 6 months of age; If such an inheritable defect is documented by the vet and is presented to the seller with sufficient supporting evidence, the buyer will be entitled to a replacement puppy of comparable quality, when available from an upcoming litter, AFTER, the first puppy is returned to the seller. 

3.       Puppy will have up to date vaccinations and wormings.  No replacements will be given in case of Parvo.  This guarantee does not cover what we consider to be normal problems for the Bulldogge breed or problems beyond our control such as:  CHERRY EYE, ENTROPIAN, LOOSE HIPS, OR SKIN ALLERGIES SUCH AS MANGE.  We are not geneticists and cannot predict genetic problems.  We do not breed dogs with undesirable conditions such as mange or bad hips, but we cannot guarantee that previous generations from other breeders did not have these conditions in their lines. Therefore we cannot guarantee that these conditions will not show up.  We cannot guarantee that the dog will not contract mange (Red Mange, Demodex Mange or any type of mite mange).  Mange is a multi-factorial genetic disease that can be transmitted in a recessive manner.  There is a great deal of dispute amongst the experts as to the differing specific causes of mange including but possibly not limited to: Environmental conditions, Stress and Nutrition. Therefore we cannot guarantee against it.

GUARANTEE IS VOID IF THE PUPPY IS NOT EXAMINED BY A LICENSED VETERINARIAN WITHIN THE FIRST TWO WEEKS OR IN CASES WHERE THE DOG IS IN ILLEGAL ACTIVITY (DOG FIGHTING), OR EXTREME SPORTS (WEIGHT PULLING), OR IS MISTREATED, MALNOURISHED, OR ABUSED.  VOID IF DOG IS BRED BEFORE 1 YEAR OF AGE.  GUARANTEE IS NON TRANSFERRABLE IF DOG IS SOLD BY BUYER.  It is understood that at the time of this sale the puppy is not considered to be of show quality or breeding quality. But it is represented as its breed and is suited as pet quality only.  There is no guarantee or warranty that the buyer will be able to breed or show the dog purchased, regardless of show or breeding potential. This guarantee is void if the dog has been bred, altered, transferred, or euthanized without the seller's written consent.

BUYER AGREES TO THE FOLLOWING:

1.      To use “Spencerman's” as a prefix in the registration of the dog.

2.      Maintain up to date vaccines, wormings, and keep the dog/pup in humane conditions providing love, proper food, water, and shelter for the dog/pup. 

3.      If by chance you are unable to keep your pup/dog Spencerman Bullies has the right to reclaim the dog/pup or we will help you in finding the dog/pup a new home.  NO REFUND IMPLIED!!

4.      If breeding rights have been given puppy is NOT to breed before one year of age!!

THE BUYER AND SELLER AGREE THAT THIS IS THE FULL AND COMPLETE AGREEMENT THAT EXISTS BETWEEN THE PARTIES FOR THE SALE OF THIS PUP/DOG.  ANY AGREEMENTS MADE PRIOR TO THIS ARE CONSIDERED INCORPORATED INTO THIS CONTRACT AND ANY OTHER MODIFICATIONS MADE TO THIS AGREEMENT SHALL BE MADE IN WRITING OR SUCH SHALL NOT BE EFFECTIVE.  BY SIGNING THIS AGREEMENT YOU AGREE TO ALL OF THE ABOVE.  THIS AGREEMENT MUST BE SIGNED AND RETURNED TO THE SELLER.
